The Federal Shariah Court has given its verdict on the petitions against the Khajasra Act. The judgment said that Sharia does not allow anyone to undergo gender reassignment.
A person cannot change gender at will. Gender may remain the same as at birth. The decision states that transgenders are entitled to all the basic rights that are listed in the constitution, the gender of a transgender will be determined based on the prevailing physical effects. A man who is dominated by male influences will be a male eunuch. The court said in the verdict that gender is related to the biological sex of a person. Many acts of worship, including prayer, fasting, Hajj, are related to sex. Gender cannot be determined by a person’s feelings.
