An order has been issued to halt trial of PTI Chairman in the cipher case being conducted in jail.

The Islamabad High Court has issued a written order to halt the jail trial of the PTI Chairman in the cipher case. Justices Mian Gul Hasan Aurangzeb and Taman Rifat Imtiaz clarified that considering the prevailing circumstances, the jail trial of the Chairman cannot be deemed as an open trial. No evidence has been presented to meet the prerequisites for conducting a trial within a prison setting.

The court emphasized the necessity of presenting any pertinent documents at the upcoming hearing. Despite claims from the Attorney General regarding the Federal Cabinet’s approval of the jail trial, no supporting documentation was provided to the court. Even the summary underlying the Cabinet’s decision could not be submitted.

The judgment stressed the significance of essential documents to ensure a fair decision in the case. It was highlighted that the legal aspect pertaining to the impact on the appellant’s fundamental rights would be addressed based on these documents. Consequently, the court has issued an injunction suspending the trial of the cipher case until the next hearing.
