In the course of a hearing, Chief Justice of Pakistan, Justice Qazi Faiz Isa, expressed his observation that numerous writs are being filed against the determinations of election tribunals.
During the session, a three-member Supreme Court bench led by Chief Justice Qazi Faiz Isa addressed the nomination papers case for Balochistan’s provincial constituency PB Ek Shirani. The court validated the nomination papers of Dr. Nawaz, the nominee from Jamiat Ulema-e-Islam, affirming the High Court’s judgment and dismissing the appeal against it.
Chief Justice Isa emphasized that it is not the court’s responsibility to delve into factual matters, as that falls under the jurisdiction of the Election Tribunal—an independent constitutional body. He urged parties to allow the Election Commission to perform its duties, stating that numerous writs are being filed against election tribunal decisions, despite the presence of High Court judges in the tribunal. The Chief Justice noted that turning to the High Court with a writ against the Election Tribunal’s decision essentially transforms it into an intra-court appeal. He advised parties to engage in electoral competition rather than seeking writs for minor issues. Furthermore, he emphasized that the Election Commission is not a private entity but a constitutional institution. It’s noteworthy that Dr. Noorullah had approached the Supreme Court challenging the Balochistan High Court’s decision.
