In the context of the PTI Chairman’s request, the Chief Justice has indicated that the Islamabad High Court could potentially offer some respite.
While addressing the appeals made by Chairman PTI, Imran Khan, regarding the Tosha Khana case, the Chief Justice inquired about the conditions under which Chairman PTI is being held in custody. It was suggested that an official written response detailing the conditions of the detention should be provided.
The Chief Justice emphasized that the federal government should furnish a written reply to Chairman PTI regarding the amenities available in the detention facility. The High Court, which is overseeing the case, will await its response. The subsequent actions will be influenced by the decisions of the High Court. There’s a possibility that the High Court might provide relief. Thus, the High Court’s determination will be awaited prior to further proceedings.
During the hearing, Justice Jamal Khan Mandukhel expressed the sentiment that it’s distressing when legal professionals make statements that undermine the credibility of the High Court. He underlined that neither a Civil Court, Magistrate, nor High Court is subservient to the Supreme Court. From Magistrates to the High Court, all hold a respectful position. No court should perceive itself as subordinate to the Supreme Court.
