In the Tosha Khana case, Chief Justice of Pakistan Umar Atta Bandyal expressed his concerns about the trial court’s swift decision, stating that it was incorrect and displayed flaws in its verdict. A Supreme Court bench, led by Chief Justice Mazahar Ali Akbar Naqvi and including Justice Jamal Khan Mandukhel, listened to Imran Khan’s appeal against the Tosha Khana case ruling.
The Election Commission’s lawyer argued that the trial court had postponed the case multiple times, yet no representation for the accused was present, leading to the session court’s decision. Justice Jamal Khan Mandukhel noted the haste in conducting the trial.
The Chief Justice highlighted that the PTI Chairman was not granted ample time to present witnesses. He criticized the trial court for delivering its decision hastily in a single day, underscoring flaws in its judgment.
The Chief Justice clarified that he is refraining from intervening at this point. He suggested leaving the decision to the High Court, with a plan to reconvene for the case in two days. As a result, the court postponed the case hearing.
It’s worth noting that District and Sessions Court Judge Humayun Dilawar sentenced the PTI Chairman to three years in prison and imposed a fine of one lakh rupees in connection with the Tosha Khana case.
