The Peshawar High Court has halted the disqualification proceedings initiated by the Election Commission against Khyber Pakhtunkhwa’s Chief Minister.
During the court session, Chief Minister Ali Amin Gandapur presented his case against the Election Commission’s disqualification notice. He argued that the Commission’s action, particularly in the assets case dated March 26, was unlawful. Gandapur contended that the Commission lacked the jurisdiction to take such action against a sitting member of the assembly once the notification had been issued, suggesting that any grievances should be directed to the Election Tribunal.
Consequently, the court suspended the ongoing disqualification proceedings against Ali Amin Gandapur and directed all involved parties to respond to the notices. Justice Ijaz Anwar emphasized that, according to a prior Supreme Court ruling, no institution holds the authority to pronounce someone as Sadiq and Amin.
