ISLAMABAD: The High Court has remarked during the hearing of the case that it appears that the government is the beneficiary of enforced disappearances.
The case related to the recovery of 2 missing brothers of Azhar Mashwani was heard by Islamabad High Court Justice Mian Gul Hasan Aurangzeb, in which the petitioner’s lawyer Babar Awan presented arguments. During the hearing, the court inquired whether anything has been known?, on which Additional Attorney General Manoor Iqbal Dogal said that even today there has been contact at a high level, and efforts are being made in all respects.
Babarawan in his arguments told the court that 5 laws deal with sedition and incitement to sedition. It is not stated anywhere what is the national interest. If you ask me what is the national interest, I will say reduce the price of electricity. The Balochistan man will say, supply me with gas, this is his national interest.
Meanwhile, SP from Punjab Police Lahore appeared before the court and told that CCTV footage has been provided by the family. Because of the low resolution, nothing could be detected by NADRA or the forensic agency. Geofencing got 10 thousand numbers but nothing is known yet. As of today, August 23, no actionable information has been received. The Safe City project cannot cover every angle. Till this time, no law enforcement agency could find anything in this regard.
The court remarked that it appears that the government is the beneficiary of the enforced disappearances. How come people are kidnapped in this country and the chief executive does nothing. The Attorney General had said that he will brief the Prime Minister on this issue. The Chief Executive is aware of these issues but still people are forcibly disappeared.
Lawyer Babarawan said that the Prime Minister does not have time to read the orders of this court.
The court inquired from the Additional Attorney General that since the case started in the Islamabad High Court, the investigation has stalled, to which he replied that the geo-fencing report has been prepared. Justice Mian Gul Hasan Aurangzeb asked since when these two are missing, to which the police officer said that they have been missing since June 6.
The court remarked that it has been 3 months since the 2 men were forcibly disappeared, we can only imagine what their families must be going through. People are being picked up but the chief executive is not doing anything. The court inquired that the Additional Attorney General! Nothing came out of the meeting between the Prime Minister and the Attorney General?
During the hearing, lawyer Babar Awan requested the Prime Minister to call the court, on which the court said that in the constitution, the head of the state is the prime minister, while the head of law is the attorney general. We called the Attorney General to the court according to a process.
Justice Mian Gul Hasan Aurangzeb said that if the government does not follow due process, then what can they say. They have no idea how much the country is being defamed by these things. I am adjourning this case till Tuesday but I will not be there on Tuesday. Don’t want to delay the case due to my absence.
The court directed the chief JITSP Lahore to submit the reports and said that the police have to see how the non-police wore the police uniform. .
On this occasion, Babar Awan requested the court to pass a strict order, on which Justice Mian Gul Hasan Aurangzeb remarked that I will pass the order on this case.
