The Lahore High Court has deferred its verdict on the plea challenging the enforcement of Section 144 in Punjab. Justice Shahid Bilal Hasan presided over the case filed by Shabbir Ismail, who contested the imposition of Section 144 in the region. The court has summoned responses from the Punjab government and the Election Commission regarding the matter.
During the hearing, the petitioner argued that with impending elections, Section 144 should not be enforced, as it primarily deals with the possession of arms, which is already a distinct offense. The petitioner further contended that if deemed necessary, the Election Commission itself should have invoked Section 144. Hence, the petitioner urged for the nullification of Section 144 by the Punjab government.
The public prosecutor informed the court about a letter addressed to the Secretary Establishment on January 27, regarding the Section 144 notification. The prosecutor cited a relevant decision of the Supreme Court of India elucidating the application of Article 144 in similar circumstances, emphasizing that its purpose is merely to regulate the display of weapons. The prosecutor questioned the need for Deputy Commissioners (DCs) to be granted additional powers. Following the completion of arguments, the Lahore High Court reserved its judgment on the matter.
