Peshawar: During the hearing of the missing persons case, the High Court remarked that if necessary, the Chief Minister would also be summoned.
Chief Justice Peshawar High Court Justice Ishtiaq Ibrahim presided over the case. The Additional Advocate General informed the court that the missing person had been arrested and is currently in jail.
The court inquired about the summons issued to the Chief Minister in this case. Advocate General Shah Faisal Atman Khel responded, mentioning a tragic incident that had occurred in Bannu the previous day. Chief Justice Ibrahim noted that similar incidents had affected the Advocate General’s party in the past and were now happening under their government. He emphasized that people regularly come to the court in distress and urged filing cases against those responsible. The Chief Justice acknowledged that some individuals exploit the situation but stressed the importance of taking action.
The Chief Justice also mentioned that people are often released on bail only to be re-arrested outside the jail. He referenced the Asad Qaiser case, where the court ruled that a person arrested in one case should be considered arrested in all related cases.
The court questioned the establishment of the Provincial Safety Commission and District Safety Commission as mandated by the Police Act, noting that it had not been notified for seven years. The Advocate General replied that steps were being taken to address this. The court stressed that notifying the safety commission would solve many issues. In response to the Advocate General’s comment about their heavy workload, the Chief Justice remarked that they had previously managed even larger tasks. The court instructed the Advocate General to submit a report within 15 days.
The hearing of the missing persons case was then adjourned, with the court reiterating that the Chief Minister could be summoned if necessary.
