
The Peshawar High Court has kept its decision pending regarding the Election Commission’s plea for a review concerning the PTI’s internal elections.
During the High Court session, discussions revolved around the Election Commission’s request to review the court’s ruling on the PTI’s intra-party elections and their use of an election symbol.
Qazi Anwar, the lawyer representing Pakistan Tehreek-e-Insaf, contended that the December 26 order hasn’t been put into action yet. Justice Ejaz Khan commented that this suggests the injunction didn’t pose any significant hurdles. He pointed out two key aspects: first, the Election Commission cannot simply retract the injunction here, and secondly, there aren’t any significant impediments to conducting elections under this order.
The Election Commission’s legal representative countered, stating that they’ve been restrained by an injunction against their order, and they hold the right to challenge it through a writ, suggesting the matter should be addressed in the Supreme Court, not here.
Qazi Anwar further argued that the Election Commission lacks the jurisdiction to nullify intra-party elections, highlighting PTI’s past participation in the 2013 and 2018 elections under the bat symbol.
Following the completion of arguments from both sides, the court decided to reserve its judgment on the matter.
