Peshawar high court ordered Election Commission to provide certified Form 45 to PTI leaders

The Peshawar High Court has directed the Election Commission to furnish certified copies of Form 45 to leaders of the Pakistan Tehreek-e-Insaf (PTI).

During a court hearing regarding petitions submitted by PTI leaders Taimur Jhagra, Kamran Bangash, and others seeking certified election result documents, the court ruled in favor of the petitioners, instructing the Election Commission to provide them with the required certified documents.

The petitioner’s legal counsel argued that under election regulations, it is the duty of the Election Commission to issue certified documents to candidates.

In response, the Election Commission’s representative stated that once Forms 45 and 47 were received by the Commission, they were promptly uploaded onto their website. Additionally, they highlighted that candidates could obtain these documents either from the Returning Officers (ROs) or through application processes.

Expressing concerns over potential alterations to Form 45 and 47, the petitioner’s lawyer emphasized the need for certified documents to prevent tampering.

Justice Shakeel Ahmed clarified that as per election rules, it is the Election Commission’s responsibility to provide certified documents, ensuring the authenticity of Form 45. He assured that once provided, the form’s integrity would be safeguarded.

Consequently, the court resolved the petitions by directing the Election Commission to supply the petitioners with certified copies of the election results documents.
