
In the PTI’s intra-party election and election symbol case, the Peshawar High Court has put off its decision on the Election Commission’s supplementary petition.
During the hearing led by Justice Ejaz Khan at the Peshawar High Court, the Election Commission’s representative contended that a review of the High Court’s decision was sought because the PTI’s internal elections weren’t conducted properly. The Election Commission had issued a notice to the PTI in this regard. The counsel stressed that the Election Commission’s authority was challenged, deeming its decision unconstitutional. The Single Bench suspended the Election Commission’s decision on the election symbol without giving the Commission a chance to be heard, despite its involvement in the matter.
The lawyer further highlighted that the federal government wasn’t involved in this case and had no role in the election commission. Therefore, it was inappropriate to make a decision without considering the Election Commission’s stance.
The Advocate General argued that as the caretaker provincial government, they aimed to remain neutral, asserting their lack of involvement. They requested their name be removed from the case, offering judicial assistance if necessary.
Justice Ejaz Khan inquired about the federal government’s stance, to which the Additional Attorney General affirmed their similar stance, stating they held no significant role in the matter.
Following these arguments presented by the Election Commission’s lawyer, the court decided to postpone its decision.
