Supreme Court; The Lahore High Court derailed the back-to-back pen election process.

The Supreme Court has released a 6-page written order regarding the general election case. In response to Barrister Umeer Niazi’s actions, the Court has issued a notice asking for an explanation, potentially considering contempt of court proceedings due to an alleged disruption of the democratic process. Umeer Niazi’s actions seemingly interfered with the smooth conduct of elections, as highlighted in the Court’s order.

The Lahore High Court’s decision to halt the work of 2753 District Returning Officers (DROs), Returning Officers (ROs), and Assistant Returning Officers (AROs), disrupting the election process, was addressed in the Supreme Court’s order. The Court clarified that these officers were already functioning in administrative roles and were not specifically appointed for elections.

To counter the impact of the Lahore High Court’s judgment, the Supreme Court suspended it and restrained further actions based on that decision. The Court emphasized that the High Court’s ruling impeded the constitutional responsibilities of the Election Commission and the fundamental right to conduct elections. It’s worth noting that Umeer Niazi, the petitioner in the Lahore High Court, is affiliated with a political party.

Furthermore, the Election Commission’s lawyer highlighted that despite requests made to the chief justices of five high courts for judicial officers, none agreed to provide assistance. The Supreme Court’s stance remains focused on ensuring the unobstructed execution of the electoral process and safeguarding constitutional obligations.
