The Islamabad High Court has deferred its decision regarding the plea to relocate Bushra Bibi from Bani Gala to Adiala Jail.
During the court session, the discussion centered on the transfer request of Bushra Bibi from Bani Gala Sub Jail to Adiala Jail. Bushra Bibi’s legal representative highlighted that Bushra Bibi was convicted in the Tosha Khana and Idt Nikah cases. After her conviction, an arrest warrant was issued, and although she wasn’t present in court during the sentencing, she voluntarily surrendered. Consequently, she was transferred to Bani Gala Ghar as a sub-jail upon the Chief Commissioner’s directive.
The lawyer contended that Bushra Bibi was initially sent to Adiala Jail as per the trial court’s order, which was then conveyed to the Superintendent of Adiala Jail. However, later, the Ministry of Home Affairs prompted an unauthorized transfer through a notification from the Chief Commissioner, relocating her to Bani Gala Sub Jail. This transfer lacked proper directives from relevant authorities such as the Superintendent of Adiala Jail, the provincial government, or the IG Jails, rendering the Chief Commissioner’s notification unlawful.
Justice Mian Gul Hasan Aurangzeb raised concerns regarding conflicting security claims: while there were purported security threats in courts necessitating hearings within jails, a security threat in the jail prompted Bushra Bibi’s relocation to a residence in Bani Gala. He queried whether it was pre-decided to transfer Bushra Bibi to Bani Gala.
Following the arguments, Justice Mian Gul Hasan Aurangzeb reserved the decision on the case.
