In Lahore, the High Court has issued orders for the Chief Commissioner of Islamabad and the Inspector General (IG) of Islamabad to safely present Parvez Elahi in court today.
Details of the case indicate that upon the arrest of Parvez Elahi, the Lahore High Court issued a show cause notice to the IG of Islamabad, instructing them to provide all relevant information during today’s court proceedings.
During the court hearing, Parvez Elahi’s attorney pointed out that the Islamabad High Court had also suspended the arrest order. The court responded, emphasizing that his arrest had been deemed illegal by the Lahore High Court, making it inappropriate for the matter to fall under Islamabad’s jurisdiction.
Parvez Elahi’s lawyer insisted that he should be brought to the Lahore High Court, as per the court’s directive. The court, in response, ordered the presence of the Chief Commissioner of Islamabad and IG Parvez Elahi in court.
The public prosecutor argued that their challenges to the court order should be heard before producing Parvez Elahi in court. The court retorted that the implementation of the court’s order must take precedence.
Earlier, in response to a plea against the arrest of Chaudhry Parvez Elahi despite a court order, the High Court summoned IG Islamabad, Chief Commissioner Islamabad, and the Superintendent of Attock Jail by 11 am.
Justice Mirza Waqas Rauf of the Lahore High Court presided over the hearing, which was initiated following a request from Parvaiz Elahi’s wife, Qaisara Elahi. The court received a contempt of court and habeas corpus petition against DIG Investigation, DIG Operations, and SSP Operations.
The court adjourned the habeas corpus plea hearing until 11 o’clock.
Throughout the hearing, the court expressed dissatisfaction with the non-appearance of Parvez Elahi. Show cause notices were issued to the IG Islamabad, questioning why they should not face contempt of court charges. The court asserted that there was a clear order to produce Parvez Elahi and called for government lawyers to provide an explanation.
The government’s attorney stated that Parvaiz Elahi had not been presented due to a heart problem, with the DC Islamabad prohibiting his travel due to illness. Ghulam Sarwar Nahang, the government lawyer, claimed that Pervez Elahi had been detained by DC Islamabad to maintain public order.
Ghulam Sarwar Nahang, Additional Advocate General of Punjab, opposed the habeas corpus petition, arguing that it was no longer justified.
Deputy Superintendent of District Jail Attock and District and Sessions Judge Attock appeared as bailiffs, reporting that Parvez Elahi could not be recovered due to his detention.
Qaisara Elahi’s lawyer argued that IG Islamabad had not appeared in contempt of court and requested their summons. The court expressed its displeasure at the non-appearance of the jail superintendent.
The public prosecutor explained that the jail superintendent had not appeared due to Imran Khan’s court appearance. Consequently, the court summoned the IG Islamabad by issuing a notice of contempt of court.
