Islamabad The Islamabad High Court issued a written decision to transfer Bushra Bibi from Bani Gala Sub Jail to Adiala Jail, in which the court said that it’s the responsibility of the state to give protection to Bushra Bibi in jail.
High Court Justice Mian Gul Hasan Aurangzeb issued a 15- runner written judgment, stating that according to the supplicant, she wanted to be kept in jail so that her insulation would be removed. There are court rulings that solitary confinement isn’t just discipline but torture. Bushra Bibi’s discipline was made more severe by keeping her in solitary confinement.
According to the written decision, Bushra Bibi’s children can not come home fluently by declaring the hearthstone as asub-jail. Her hubby’s children and family members also have to get authorization from the supervisor of Jails or the court to come home. There’s nothing on record that the authorization of the property proprietor was taken before issuing the announcement declaring the hearthstone as asub-jail. Virtual possession of private property was achieved by declaring the hearthstone asub-jail. He was deprived of his abecedarian rights by declaring his hearthstone asub-jail without the authorization of the property proprietor.
In the decision, the court also stated the reasons for vacating the announcement declaring Bani Gala hearthstone as asub-jail. The court said in the judgment that according to the supervisor, Bushra Bibi was transferred tosub-jail after being admitted as a condemned internee in Adiala Jail. According to the supervisor, on his request, Chief Commissioner Islamabad issued a announcement to declare Khan House as asub-jail.
According to the decision, the Chief Commissioner didn’t specify the reasons in the announcement for declaring Khan House as asub-jail. According to the report, there are more captures in Adiala Jail, all were kept in Jail for the protection of Bushra Bibi. According to the report, the jail has a capacity of 2174 but 7 thousand captures, 250 women are locked in the place of keeping 75 women.
The court said that according to the records, 125 further women were brought to the jail after keeping Bushra Bibi in Sub Jail. It’s the responsibility of the state to give protection to Bushra Bibi in jail. Order of IG incarcerations is necessary for transfer of condemned internee from jail. There’s no order of IG incarcerations to transfer Bushra Bibi from Adiala Jail to Sub Jail.
