In Lahore, the High Court has postponed a hearing until tomorrow and instructed the Chief Commissioner of Islamabad and the Inspector General of Islamabad to ensure the safe production of Parvez Elahi.
During the resumption of the case, Pervaiz Elahi’s lawyer stated that the Islamabad High Court’s order has also been temporarily suspended. The court responded by questioning how this matter could fall under Islamabad’s jurisdiction when Lahore High Court had declared his arrest illegal.
Pervaiz Elahi’s lawyer insisted that he should be presented in Lahore High Court as per their previous order. Consequently, the court directed the Chief Commissioner of Islamabad and IG Parvez Elahi to appear in court.
The public prosecutor argued that their challenge to the court’s order should be heard before Parvez Elahi is produced. However, the court emphasized that their priority is to implement its own order.
Previously, the High Court had summoned the IG Islamabad, Chief Commissioner Islamabad, and Superintendent of Attock Jail at 11 am in response to a plea against the arrest of Chaudhry Pervaiz Elahi, despite a court order.
Justice Mirza Waqas Rauf of the Lahore High Court presided over the hearing regarding the request from Parvaiz Elahi’s wife, Qaisara Elahi. A contempt of court and habeas corpus petition were filed against DIG Investigation, DIG Operations, and SSP Operations.
The court adjourned the habeas corpus hearing until 11 o’clock.
During the hearing, the court expressed its displeasure at the non-appearance of Parvez Elahi and issued show cause notices to the IG Islamabad, questioning why they should not be held in contempt of court. The court stressed that there was a clear order to produce Parvez Elahi and requested lawyers from the federal government to provide an explanation.
The government’s lawyer explained that Parvez Elahi was not presented due to a heart problem, as the DC Islamabad had prohibited his travel due to illness. The lawyer also stated that Parvez Elahi had been detained by the DC Islamabad due to concerns about public order.
Additional Advocate General Punjab, Ghulam Sarwar Nahang, opposed the habeas corpus petition, arguing that it was no longer justified.
Deputy Superintendent of District Jail Attock and District and Sessions Judge Attock appeared as bailiffs, reporting that Parvez Elahi could not be located due to his detention.
Qaisara Elahi’s lawyer demanded that the IG Islamabad be summoned for contempt of court due to his non-appearance. The court agreed and issued a notice for the IG Islamabad to appear.
